Maine Legislature Recalls Gun Control Bill

In an unusual move, the Maine Legislature recalled LD 1902, a bill that would require the state of Maine to supply the FBI with more information than it currently does about the mental health of individuals as it pertains to being able to buy a gun.

The bill had easily passed both House and Senate and was waiting for Gov. Baldacci’s signature. He was intending to sign the bill but due to what Sen. Bill Diamond of Windham says is a technical problem too big to allow the bill to become law, it needed to be recalled. Diamond says he still supports the essence of the gun control bill.

At issue is who has the authority to reverse the gun buying ban once a person is declared healthy again. A federal law would grant that authority only to the U.S. Attorney General. Maine’s bill would give that authority to the Public Safety Commissioner. The Maine bill also failed to provide a means for appeal.

Legislators feared passage of such a bill in conflict with federal law would eliminate needed federal dollars for public safety programs.
